Terms of Service

Welcome to DaaaWorkshop. These Terms and Conditions ("Terms") outline the rules for using our website available atwww.DaaaWorkshop.pl ("Service") and the rules for purchasing products offered in our store.

By using the Service or making purchases, you accept the provisions of these Terms.
If you do not agree with its content, you should not use the Service.

1. Eligibility to Use the Service

By using the Service, you declare that:

you are at least 18 years old or
you have obtained consent from a parent or legal guardian,
you will use the Service solely for purposes compliant with applicable law.

2. Products and Availability

DaaaWorkshop offers figurines and accessories for diorama bases made of resin, as well as related modeling products.

All products:

are offered subject to availability,
may be changed, updated, or withdrawn from the offer at any time without prior notice,
may slightly differ in color, finish, or appearance due to the production process, materials used, or display settings on the user's devices.

We reserve the right to limit the number of ordered products or refuse to fulfill an order at our discretion.

3. Orders and Conclusion of Contract

Placing an order does not mean automatic acceptance.

A sales contract is concluded only at the moment when:

the order is accepted by us and
the payment is successfully processed.

We reserve the right to:

refuse to accept or cancel any order,
cancel an order in case of suspected fraud, pricing errors, or product availability issues.

If an order is canceled after payment has been made, the customer will receive a full refund of the funds paid.

4. Prices and Payments

All prices are quoted in euros (EUR), unless stated otherwise.
Prices may change at any time without prior notice.
All applicable taxes, customs duties, and import fees are borne by the customer unless explicitly stated otherwise.
The customer agrees to provide accurate billing and payment information.

5. Shipping and Delivery

We make every effort to ensure that orders are processed and shipped as quickly as possible. The provided delivery times are indicative and do not constitute a guarantee.

DaaaWorkshop is not liable for:

delays caused by carriers,
delays resulting from customs clearance or import restrictions,
incorrect address details provided by the customer.

The risk of loss or damage to the goods passes to the customer upon delivery.

6. Returns and Complaints

7. Intellectual Property

All content posted on the Service, including but not limited to:

texts,
photos,
product designs,
logos and visual identity elements,

is the property of DaaaWorkshop and is protected by intellectual property laws.

Without our prior written consent, copying, reproducing, distributing, or using any content found in the Service is prohibited.

8. Rules for Using the Service

The user agrees not to:

use the Service for illegal purposes,
disrupt the functioning or security of the Service,
attempt unauthorized access to systems or data,
provide false or misleading information.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DaaaWorkshop is not liable for:

indirect, incidental, special, punitive, or consequential damages,
loss of profits, revenues, business opportunities, or data,
bodily injury or property damage resulting from improper use of products,
errors, inaccuracies, or omissions in the content posted on the Service,
unauthorized access to our systems or their use.

For customers located in the United States, to the extent permitted by law:

DaaaWorkshop's total liability does not exceed the amount paid for the product that is the basis of the claim,
all implied warranties, including those regarding merchantability and fitness for a particular purpose, are excluded to the extent permitted by law.

Some jurisdictions do not allow certain limitations of liability, so some of the above provisions may not apply.

10. Statement on product usage

Our products are intended solely for hobby and display purposes.

The buyer acknowledges that:

some products (e.g., made of resin or containing small parts) may pose a hazard if used improperly,
products are not intended for children unless explicitly stated otherwise.

DaaaWorkshop is not liable for:

injuries resulting from improper use of the products,
modifications or alterations made by the customer,
use of the products contrary to their intended purpose.

11. Governing law

These Terms and Conditions are governed by the laws of the Republic of Poland and will be interpreted in accordance with them, excluding conflict of law rules.

Consumers may also benefit from the mandatory consumer protection provisions applicable in their place of residence.

12. Changes to the Terms

We reserve the right to update or change these Terms at any time.

Changes take effect from the moment they are published on the Service. Continued use of the Service signifies acceptance of the updated Terms.
